Here’s a surprising fact: lots of used cars are sold while there’s still money owed on them. Usually it’s an innocent mix-up, the seller plans to settle up from the sale. But if they don’t, that unpaid finance can turn your new car into a big headache. A car finance check is the simple way to find out before you pay.
What is outstanding car finance?
When someone buys a car on hire purchase (HP) or a PCP deal, the finance company technically owns the car until the last payment is made. The driver is really just borrowing it. If they sell the car before paying off the agreement, the finance company still has an interest in it.
Logbook loans are different again. That’s where someone borrows money against a car they already own, and the lender can have the right to take the car if the loan isn’t repaid.
What happens if you buy a car with finance on it?
The good news: UK law often protects private buyers. Under the Hire Purchase Act 1964, if you buy a car privately, in good faith, without knowing about an HP or conditional sale agreement, you can usually keep it, and the finance company has to chase the original borrower instead.
The less good news:
- You may have to prove you bought in good faith, which can mean letters, delays and stress.
- The protection doesn’t cover logbook loans in the same way, so a lender may still try to repossess.
- If an HPI check showed finance and you bought anyway, it’s hard to argue you didn’t know.
- Selling the car later can be tricky while a finance marker is still showing.

- Don’t hand over any money yet. Not even a deposit.
- Talk to the seller. There’s often a simple explanation. Ask them to get a settlement figure from the finance company.
- Get it settled first. The cleanest option is for the seller to clear the finance before the sale and show you written confirmation from the lender.
- Re-check. Run another HPI check once it’s paid off, as records can take a few days to update.
- If anything feels off, walk away. There are plenty more cars out there.

Will a finance check show a personal loan?
No. An ordinary unsecured bank loan isn't tied to the car, so it won't show up, and it isn't your problem as the buyer. Finance checks look for agreements secured on the car itself, like hire purchase, PCP and logbook loans.
How long does finance take to clear once it's paid off?
Usually a few working days, as the lender has to update its records. Ask the seller for written confirmation from the finance company, then run another check before you pay.
