Every Ultimate check includes our Data Guarantee of up to £30,000. If the outstanding finance, stolen or write-off information in your report was wrong and you lose money as a result, we’ll compensate you, subject to the terms below.
The Data Guarantee is provided by Hill Davenport Limited, which operates CheckHPI, and forms part of our Terms & Conditions.
What’s covered
The Data Guarantee covers your financial loss if, at the time your Ultimate report was produced:
- Outstanding finance: a finance agreement was recorded against the vehicle but the report showed no outstanding finance, and a lender later recovers the vehicle or makes a valid claim against you.
- Stolen: the vehicle was recorded by the police as stolen but the report did not show it, and the vehicle is later recovered from you.
- Write-off: the vehicle was recorded as an insurance write-off (Cat A, B, S or N) but the report did not show it.
How much we’ll pay
- For finance and stolen claims: your actual financial loss, up to the price you paid for the vehicle.
- For write-off claims: the difference between the price you paid and the vehicle’s market value with its write-off history at the time you bought it.
In every case, the most we will pay is £30,000 per report, less any money you recover from anyone else, such as the seller, a lender or an insurer.
Conditions
To make a valid claim, all of the following must apply:
- You bought an Ultimate check for the vehicle and the claim is made by the person who bought the check.
- You bought the vehicle within 7 days of the date the report was produced.
- The registration number and VIN shown on the vehicle and its V5C logbook matched those in your report.
- You bought the vehicle as a private individual, for your own use, and not for resale or as part of a business.
- You bought the vehicle from the registered keeper shown on the V5C, at the address on the V5C, or from a motor trader at its business premises.
- You paid a fair price and kept proof of payment.
- You act honestly and give us all the information and documents we reasonably ask for.
What’s not covered
- Records that were added, changed or created after your report was produced.
- Information other than the outstanding finance, stolen and write-off sections, such as mileage, keeper history, MOT, tax or valuation.
- The mechanical condition, roadworthiness or quality of the vehicle.
- Vehicles where the registration or VIN had been altered, cloned or tampered with so that the report related to a different vehicle.
- Losses where you knew, or should reasonably have known, about the problem, for example because the seller told you.
- Indirect losses, such as loss of use, travel, hire costs, insurance premiums or interest.
- Claims involving fraud or dishonesty by you or anyone acting with you.
How to make a claim
Contact us at [email protected] or on 0333 344 8266 as soon as you become aware of the problem, and in any case within 6 months of the date of your report. Please provide:
- your report and order confirmation
- proof of purchase, including the price paid, date and seller’s details
- a copy of the V5C logbook
- evidence of the problem, such as correspondence from a lender, the police or an insurer
- evidence of your financial loss
We’ll acknowledge your claim within two working days and aim to give you a decision within 28 days of receiving all the information we need.
If we pay a claim
If we pay your claim, you agree to transfer to us any rights you have to recover the money from others, such as the seller, and to help us pursue them where reasonable. Only one claim can be made per report.
Your other rights
The Data Guarantee is in addition to your legal rights, not instead of them. If you disagree with a decision on your claim, you can use our complaints process.
